1. Introduction
This document is an electronic record in accordance with the provisions of the Information Technology Act, 2000 and applicable rules thereunder. It does not require any physical or digital signatures.
This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011. The website www.flowhora.com and related services (“Platform”) are owned and operated by FlowHora (hereinafter referred to as “Company”, “we”, “us”, or “our”). By accessing or using our Platform and Services, you agree to be bound by these Terms & Conditions, along with our Privacy Policy and Refund Policy.
2. Acceptance of Terms
By accessing, browsing, or using FlowHora services, you:
- Confirm that you have read and understood these Terms
- Agree to comply with all applicable laws and regulations
- Accept these Terms as a legally binding agreement
If you do not agree, you must not use the Platform.
3. Services
FlowHora provides:
- WhatsApp Business API solutions
- Messaging automation and chatbot tools
- Campaign management and analytics
We act solely as a technology platform provider and do not control or initiate user communications.
4. User Registration & Account
- You must provide accurate and complete information
- You are responsible for maintaining account confidentiality
- All activities under your account are your responsibility
- You must immediately notify us of any unauthorized access
5. User Obligations & Restrictions
You agree NOT to:
- Send spam, unsolicited, or illegal messages
- Violate WhatsApp / Meta policies
- Use scraped, purchased, or unauthorized data
- Engage in fraud, abuse, or harmful activity
- Reverse-engineer or misuse the platform
Violation may lead to suspension or termination.
6. Payments & Billing
- Services are provided on a subscription basis (monthly/annual)
- Fees must be paid in advance
- Non-payment may result in suspension or termination
- All payments are non-refundable except as per Refund Policy
7. Intellectual Property
- All platform content, software, and design belong to FlowHora
- You are granted a limited, non-transferable license to use the services
- Unauthorized use may result in legal action
8. Third-Party Services
- Our platform integrates with third-party services (e.g., WhatsApp API)
- Use of such services is subject to their respective policies
- FlowHora is not responsible for third-party actions or downtime
9. Data & Privacy
- Data is processed in accordance with our Privacy Policy
- Users are responsible for lawful data collection and consent
- FlowHora acts as a data processor, not a data controller
10. Service Availability
- We strive for uninterrupted service but do not guarantee uptime
- Services may be affected by maintenance, updates, or third-party issues
11. Termination
We may suspend or terminate your account if:
- You violate these Terms
- You fail to make payments
- Required by law or regulatory authority
You may terminate your account at any time as per our cancellation policy.
12. Limitation of Liability
To the maximum extent permitted by law:
- FlowHora is not liable for indirect, incidental, or consequential damages
- We are not responsible for message delivery failures due to third parties
- Total liability is limited to fees paid in the last 12 months
13. Indemnification
You agree to indemnify and hold harmless FlowHora, its directors, employees, and affiliates from:
- Any claims arising from your use of services
- Violation of laws or third-party rights
- Breach of these Terms
14. Force Majeure
We are not liable for failure or delay due to events beyond our control, including:
- Natural disasters
- Government actions
- Network failures
- Third-party service disruptions
15. Governing Law & Jurisdiction
These Terms are governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of courts in:
